Mediation
A lot of times the courts require parties to go to mediation, but often people can attend on their own accord to see if the case can be resolved without the need or risk of going to trial.
Mediation is when the opposite sides come together with a neutral third party who knows nothing about the case and they try to work with the parties to come to a resolution that both parties can be happy with. When parties settle an issue – no matter what type of case it is – both sides are going to compromise, which makes mediation such a useful tool to do so.
Because of the this, we often recommend that our clients go through the mediation process so that they have the opportunity to actively participate in the settlement process, versus when you go to court and have a trial before a Judge, the Judge is the one who makes the determination regarding all issues, resulting in less control for the client. Mediation can also be referred to as ADR, or Alternative Dispute Resolution, since it’s giving parties an alternate way to resolve their dispute.
