- Your home must be tested for toxic mold by an expert to determine the spore count and indoor air quality and you must still be living on the premises at the time of the testing.
- The medical issues you are experiencing must be documented and treated.
This means if you are suffering problems with your health, you must:
- Obtain a medical report from a mold illness practitioner stating that your health problems are directly related to the toxic mold exposure
- Have a blood test showing that you have mold in your bloodstream
- Undergo a medical detoxification to remove the mold from your bloodstream
- The damage caused to your personal property must be permanent and must be documented.
If your personal property was damaged, you will need to provide:
- Photos of the mold damage
- A written report from a mold testing expert stating that the item(s) are permanently ruined and cannot be salvaged or professionally cleaned (for example, porous furnishings like mattresses cannot simply be taken to the dry cleaner to have mold removed in the same way that clothing can)
- Receipts showing the amount of money you paid for each of the damaged items
